Restitution Information
If you are a victim in a criminal case in which you have sustained bodily injury and wish us to seek restitution for medical bills, you will be asked to sign a Release of Medical Billing Information from your medical providers.
If you are a victim in a criminal case in which you have sustained personal property damage/loss and you wish our office to seek restitution for that damage/loss, you must provide our office with receipts and/or estimate(s) for repairs, value of items, pawn receipts, etc. If you have filed an insurance claim, you must provide our office with the Insurance Provider Name, Claim and Contact information.
If any restitution is COURT ORDERED and/or collected it will be paid as follows:
- To the Victim for any “out of pocket” expenses, but only if receipts are provided
- To the Medical Provider(s), but only if you have signed a Release allowing us to obtain that information and/or you have provided us with the medical bills
- To the insurance provider, but only if you provide us with their name/claim#/contact information and the amount(s) paid
- If you are insured thru MEDICARE/MEDICAID, any restitution collected will be sent directly to MEDICARE/MEDICAID and you must provide our office with that information
IF YOU ARE ELIGIBLE FOR ARKANSAS CRIME VICTIMS REPARATIONS AND THEY MAKE PAYMENT ON YOUR BEHALF TO YOUR MEDICAL PROVIDERS, ANY RESTITUTION WILL BE PAID BACK TO THE ARKANSAS CRIME VICTIMS’ REPARATIONS FUND.
Any restitution that is court ordered may only be collected for documented expenses. We are not allowed to collect restitution for pain and suffering.
